Article 1: General provisions

The electronic webshop of Kamado BBQ, with registered offices in Zelem (Belgium), VAT BE0681.486.861, (hereinafter “Kamado BBQ”) offers its customers the opportunity to purchase goods and services online.
These general terms and conditions (“Conditions”) apply to any order placed by a visitor to this website (“Customer”) with Kamado BBQ. Placing an order via the Kamado BBQ webshop implies that the Customer has consulted these Terms and Conditions and explicitly accepts their applicability to the exclusion of all other terms and conditions. Additional terms and conditions of the customer are excluded, unless they have been previously, explicitly and in writing accepted by Kamado BBQ.

 

Article 2: Price

All prices are in EURO, including VAT and all other taxes that the customer is obliged to pay. If delivery, reservation or administrative costs are charged, this will be indicated separately.

The price stated refers exclusively to the articles as described word for word. The accompanying photo is for decorative purposes only and may contain elements of articles not included in the price.

 

Article 3: Offer

All offers are only open to customers residing in the European Union. The articles are exclusively intended for normal private or professional use.

Despite the fact that the catalogue and the website are compiled with the greatest possible care, it is still possible that the information offered is incomplete, contains material errors or is not up to date. Obvious mistakes or errors in the offer do not bind Kamado BBQ. Kamado BBQ is only bound by a best efforts obligation as far as the accuracy and completeness of the information offered are concerned. Kamado BBQ cannot be held responsible in any way for material errors, misprints or printing errors.

If you have specific questions about, for example, sizes, colours, availability, delivery period or delivery method, we request that you contact our customer service department first (see article 13).

The offer is valid while stocks last and can at any time be adjusted or withdrawn by Kamado BBQ. Kamado BBQ cannot be held responsible for the unavailability of a product.

 

Article 4: Online purchases

Online purchases follow the procedures and steps to be followed through the webshop.

 

The customer has the choice between the following payment methods:

The purchase will be completed when the amount due has been transferred to the account of Kamado BBQ (BE62 7360 4313 5661) and the customer receives a confirmation email from Kamado BBQ.

The articles will be delivered to the customer’s home on the delivery date indicated in the confirmation email.

Kamado BBQ reserves the right to refuse an order (in writing) due to a serious shortcoming of the customer regarding the order or any other order or agreement involving the customer.

 

Article 5: Retention of title

The delivered articles remain the exclusive property of Kamado BBQ until paid for in full by the customer.

The risk of loss or damage is transferred to the customer upon delivery. The customer undertakes, if necessary, to inform third parties of Kamado BBQ’s retention of title, for example to anyone who may come to seize articles that have not yet been paid for in full.

 

Article 6: Penalties for non-payment

Without prejudice to Kamado BBQ’s other rights, in the event of non-payment or late payment, the customer will be liable, automatically and without warning, to interest of 10% per year on the unpaid amount. In addition, the customer shall, by operation of law and without further notice, be liable to pay a fixed compensation of 10% on the amount concerned, with a minimum of EUR 25 per invoice.

Without prejudice to the above, Kamado BBQ reserves the right to take back articles that have not been paid for (in full).

 

Article 7: Delivery

The delivery of the goods ordered by the customer takes place within a period of 2 to 5 working days after receipt of payment by Kamado BBQ. The cost of delivery depends on the product and is mentioned in the webshop. Kamado BBQ is not responsible for any delay in delivery. If Kamado BBQ is unable to meet the delivery deadline of 2 to 5 working days, the customer will be informed by email.

Any visible damage and/or qualitative shortcomings of an article or any other shortcomings of the delivery must be reported within 24 hours after receipt of the delivery.

 

Article 8: Warranty

a. Legal warranty (only for consumers)
Under the Act of 21 September 2004 on the protection of consumers when selling consumer goods, the consumer has legal rights. Each article is subject to the legal warranty from the date of purchase by (or delivery to) the first owner. Any commercial guarantee leaves these rights intact.

b. General
In order to make a claim under the warranty, the customer must be able to present the proof of purchase.

For articles purchased online and delivered to the customer’s home, the customer must contact the Kamado BBQ customer service team in advance, after which the customer must return the article to Kamado BBQ at his/her own expense.

Any defect must be reported by the consumer within 2 months of its discovery. After that time, any right to repair or replacement lapses.

The warranty shall never apply to defects caused by accidents, neglect, falls, abnormal or incorrect use, use of the item contrary to the purpose for which it was designed, failure to comply with the user instructions or manual, adjustments or modifications to the item, heavy-handed use or poor maintenance.

It is also not applicable to articles with a shorter lifespan, or wear items.

Defects that become apparent after a period of 6 months following the date of purchase, or delivery if applicable, are not considered to be hidden defects, unless the Customer can prove otherwise.

The guarantee is not transferable.

 

Article 9: Right of withdrawal

The provisions of this article shall only apply to customers who purchase items online in their capacity as consumers.
The consumer has the right to inform Kamado BBQ that he renounces the purchase, without payment of any penalty and without giving any reason, within 14 days from the day following the delivery of the product.
Customers wishing to exercise the right of withdrawal must contact the Kamado BBQ customer service department in writing within 14 days of delivery and return the goods at their own expense within 20 days of delivery to

Goods with a retail price of 100 Euro or more must be returned to us by courier (DHL, Fedex, etc).

The customer may not use the products during the withdrawal period. If the returned product is damaged or diminished in value in any way, Kamado BBQ reserves the right to claim compensation for any diminution in value attributable to the customer.

Only items that are in their original packaging, together with all accessories, instructions and invoice or proof of purchase can be taken back.
Unless otherwise agreed, the customer may not exercise the right of withdrawal for agreements :

1° relating to the provision of services the execution of which has begun with the customer’s consent before the end of the withdrawal period;
2° concerning the delivery of goods made to the customer’s specifications or which have a clearly personal character or which, by their nature, cannot be returned or are liable to deteriorate or expire rapidly
3° concerning the delivery of audio and video recordings and computer software of which the seal has been broken by the customer; and
4° concerning the delivery of newspapers, magazines and periodicals;

 

Article 10: Privacy

The controller, Kamado BBQ Zandstraat 17 3545 Zelem Belgium, respects the Belgian law of 8 December 1992 on the protection of privacy in the processing of personal data.

The personal details provided by you will only be used for the following purposes: the execution of the agreement, the processing of the order, sending newsletters, advertising and/or marketing purposes.

You have a legal right to inspect and possibly correct your personal data. Subject to proof of identity (copy of identity card), you can obtain a written, dated and signed request to Kamado BBQ, Zandstraat 17 Zelem, info@kamadobbq.be, free of charge, for your personal details. If necessary, you can also ask to correct the data that are incorrect, incomplete or irrelevant.

In case of use of data for direct marketing: You can object free of charge against the use of your data for direct marketing. To do so, please contact Kamado BBQ, Zandstraat 17, 3545 Zelem, info@kamadobbq.be.

We treat your details as confidential information and will not pass them on, rent or sell them to third parties.

The customer is responsible for keeping his login details confidential and for the use of his password. Your password is stored encrypted, Kamado BBQ has no access to it.

Kamado BBQ keeps online (anonymous) visitor statistics to see which pages of the website are visited and to what extent. If you have any questions about this privacy statement, please contact us at Kamado BBQ.

Article 11: Use of cookies

During a visit to the site, ‘cookies’ may be placed on the hard disk of your computer. A cookie is a text file that is placed by a website server in the browser of your computer or mobile device when you consult a website. Cookies cannot be used to identify individuals; a cookie can only identify a machine.

The site uses ‘Third Party Cookies’ from Google Analytics.

You can set your Internet browser so that cookies are not accepted, that you receive a warning when a cookie is installed or that the cookies are subsequently removed from your hard disk. You can do this through your browser settings (via the help function). Please note, however, that certain graphic elements may not appear correctly or that you may not be able to use certain applications.

Article 12: Invalidity – non-waivers

If any provision of these Terms and Conditions is declared invalid, unlawful or void, this shall not in any way affect the validity, lawfulness and applicability of the other provisions.

Kamado BBQ’s failure at any time to enforce any of the rights enumerated in these Terms, or to exercise any of them, shall never be considered a waiver of such provision and shall not affect the validity of these rights.

Article 14: Amendment of the terms

These Terms and Conditions are supplemented by other terms and conditions explicitly referred to, and the general sales conditions of Kamado BBQ. In the event of contradiction, these Terms and Conditions will prevail.
Kamado BBQ may amend these Terms and Conditions at any time without further notice. Any purchase made after the amendment constitutes an acceptance by the customer of these new Terms and Conditions.

 

Article 15: Proof

 The customer accepts that electronic communications and back-ups can serve as proof.

 

   

Article 16: Applicable law – Competent court

Belgian law is applicable, with the exception of the provisions of international private law concerning applicable law and the Rome I Regulation on international sales contracts for movable goods. Disputes fall under the exclusive jurisdiction of the courts of the district where Kamado BBQ has its registered office, unless Kamado BBQ decides that the courts of the district where the customer has his residence or registered office are competent.
